2024年8月2日上午10時(shí)許，由深圳市福田區(qū)司法局、深圳大學(xué)主辦，深圳市律師協(xié)會(huì)等單位支持，中國(guó)法學(xué)會(huì)法學(xué)教育研究會(huì)等單位指導(dǎo)的首屆“涉外法治與灣區(qū)實(shí)踐”夏令營(yíng)全英模擬仲裁庭競(jìng)賽決賽在深圳大學(xué)麗湖校區(qū)舉行。

此次模擬仲裁庭競(jìng)賽在本屆夏令營(yíng)營(yíng)員中開展，每位營(yíng)員自愿報(bào)名，根據(jù)報(bào)名人數(shù)隨機(jī)分為四組并分為 Claimant 和 Respondent 兩方，每組6-8人，在每輪庭前辯論中，每個(gè)賽隊(duì)小組由兩名學(xué)生擔(dān)任庭辯選手（Oralist/Counsel）。相同或不同的學(xué)生成員可以在不同輪次中參與。初賽中獲勝的兩組晉級(jí)決賽。

全英模擬仲裁庭競(jìng)賽作為夏令營(yíng)的核心環(huán)節(jié)之一，旨在通過模擬真實(shí)的國(guó)際法律糾紛場(chǎng)景，鍛煉學(xué)生的法律研究能力、邏輯推理能力、口頭及書面表達(dá)能力，以及跨文化溝通能力。所有的研究、寫作和編輯工作，尤其是案例檢索，均由學(xué)生團(tuán)隊(duì)成員獨(dú)立完成。

我所權(quán)益合伙人譚岳奇律師受邀擔(dān)任本次全英模擬仲裁庭決賽評(píng)委及仲裁員。決賽仲裁庭中另外兩位仲裁員為來自香港 Central Chambers 的何仕景大律師、Gary Soo's Chambers 的周立新大律師（首席仲裁員），二人均為香港執(zhí)業(yè)大律師。何仕景大律師同時(shí)為中銀-力圖-方氏（橫琴·深圳）聯(lián)營(yíng)律師事務(wù)所律師。決賽中兩組隊(duì)員分別擔(dān)任申請(qǐng)人（Claimant）與被申請(qǐng)人（Respondent）。隊(duì)員們英文表達(dá)流利，辯論思路清晰，法律分析中肯，對(duì)抗十分激烈。

本次比賽的模擬案例涉及到三個(gè)國(guó)家的法律，聯(lián)合國(guó)國(guó)際貨物銷售合同公約（CISG），承認(rèn)及執(zhí)行外國(guó)仲裁裁決公約（《紐約公約》），聯(lián)合國(guó)國(guó)際貿(mào)易法委員會(huì)國(guó)際商事仲裁示范法（UNCITRAL Model Law on International Commercial Arbitration）以及復(fù)雜的事實(shí)關(guān)系，對(duì)雙方隊(duì)員構(gòu)成了很大的挑戰(zhàn)。

在庭審過程中，為了考察雙方隊(duì)員對(duì)于案件事實(shí)的熟悉程度，國(guó)內(nèi)法律及國(guó)際公約的掌握情況，譚岳奇律師和其他兩位大律師針對(duì)兩方隊(duì)員從事實(shí)上、法律上和邏輯上進(jìn)行了發(fā)問和追問，極大地考驗(yàn)了雙方隊(duì)員的臨場(chǎng)反應(yīng)能力和辯論水平。

最后經(jīng)仲裁庭評(píng)判，由季曉宸（對(duì)外經(jīng)濟(jì)貿(mào)易大學(xué)）、金娜延（同濟(jì)大學(xué)）等8名同學(xué)代表的申請(qǐng)人一方獲勝。由李嘉銘（湘潭大學(xué)）、李輝（海南大學(xué)）等8名同學(xué)代表的被申請(qǐng)人一方榮獲亞軍。庭后，三名仲裁員用英文對(duì)兩隊(duì)隊(duì)員的表現(xiàn)進(jìn)行評(píng)述并提出殷切建議。

譚岳奇律師在處理跨境工程糾紛、跨境投資、國(guó)際貿(mào)易等法律事務(wù)方面擁有豐富經(jīng)驗(yàn)。在本次決賽中，譚律師憑借其嚴(yán)謹(jǐn)?shù)膽B(tài)度、敏銳的洞察力和流利的英語(yǔ)表達(dá)，為競(jìng)賽增添了濃厚的專業(yè)氛圍，也為學(xué)生們上了一堂生動(dòng)的“實(shí)戰(zhàn)”課程。

Mr. Yueqi(Vincent) Tan is invited to be an Arbitrator of the Final All-English Moot Court of the First "GBA Practice of the Rule of Law in Foreign-related Matters" Summer Camp

At around 10:00 a.m., 2 August 2024, the moot court of the first "GBA Practice of the Rule of Law in Foreign-related Matters" summer camp, organized by Justice Bureau of Futian District in Shenzhen City and Shenzhen University, supported by Shenzhen Lawyers Association and other institutions, mentored by China Association for Legal Education of China Law Society and other institutions, was held at Shenzhen University’s Lihu campus.

The Moot Court Competition is carried out among the students of this summer camp. Each student voluntarily applies for the competition, and according to the number of applicants, they are randomly divided into four groups and divided into Claimant and Respondent, with 6-8 students in each group. In each round of pre-court debates, two students in each group act as the oralist/counsel. The same or different students may participate in different rounds. The two teams that win the preliminary round advance to the final.

The Moot Court Competition, as one of the core aspects of the camp, aims to hone students' legal research skills, logical reasoning skills, oral and written expression skills, and cross-cultural communication skills by simulating real-life international legal dispute scenarios. All research, writing work, especially case searching, are done independently by students.

As a senior partner of Zhongyin(Shenzhen) Law Firm, Mr. Yueqi(Vincent) Tan, is invited to serve as a judge and arbitrator for this final moot court. The other two arbitrators are Shijing He from Central Chambers and Lixin Zhou(presiding arbitrator) from Gary Soo's Chambers. They are also qualified barristers in Hong Kong. Shijing He also works in ZLF Law Office. In the final, two groups of students are the Claimant and the Respondent respectively. These student are fluent in English, their line of thinking is clear with pertinent legal analyses, and their arguments against each other are persuasive.

The case of this competition involved the laws of three countries, the United Nations Convention on Contracts for the International Sale of Goods (CISG), the Convention on the Recognition and Enforcement of Foreign Arbitral Awards (New York Convention), the UNCITRAL Model Law on International Commercial Arbitration and complicated factual relationships, which pose great challenges to both team members.

In the course of the moot, in order to examine the familiarity of both team members with the facts of the case and their mastery of domestic laws and international conventions, Mr. Yueqi(Vincent) Tan and the other two barristers ask questions on the facts, laws and logic of the two team members, which greatly test the their ability to improvise and to debate.

Finally, after the arbitral tribunal's deliberation, the Claimant represented by Xiaochen Ji(University of International Business and Economics), Nayan Jin(Tongji University) and other eight students is awarded the championship title. The Respondent represented by Jiaming Li(Xiangtan University), Hui Li(Hainan University)and other eight students wins the second place. After the competition, the three arbitrators comment on the performance of the members of the two teams and make earnest suggestions in English.

Mr. Tan has extensive experience in handling cross-border construction disputes, cross-border investment, international trade and other legal affairs. In this moot, Mr. Tan, with his rigorous attitude, keen insight and fluent speaking skills, adds a strong professional atmosphere to the competition, and also gives the students a vivid practical course.
