2024年4月15日，北京中銀律師事務所閆鵬和律師、張逸軒律師以及北京中銀（深圳）律師事務所譚岳奇律師受邀，赴莫斯科參加由Pravo.ru（俄羅斯最大的線上法律媒體）、Ingvarr及北京中銀律師事務所共同組織的中俄法律專業(yè)論壇Russia-China Legal Forum。
本次論壇匯聚了約150位人士，其中包括福布斯全球榜單上名列前茅的俄羅斯大型企業(yè)以及多家知名公司的法務領軍人物與法律精英團隊，同時也不乏中俄兩國的優(yōu)秀律師代表。與會者們齊聚一堂，深入探討了如何借助法律的力量進一步推動中俄商務合作的繁榮發(fā)展，并就中俄兩國在企業(yè)家思維方式和立法監(jiān)管體系上存在的差異進行了富有成效的交流與探討。
首先閆鵬和律師介紹了中國的外商投資企業(yè)以及企業(yè)并購的法律問題，張逸軒律師針對時代背景下的科技發(fā)展，論述了國際業(yè)務中知識產權的保護問題。最后，譚岳奇律師從訴訟與仲裁角度介紹了中國涉外爭議解決的方式。
其中譚岳奇律師針對爭議解決的方式，從中國涉外訴訟的特點以及商事仲裁的情況出發(fā)，向與會嘉賓介紹了中國涉外訴訟中的管轄、適用法律以及民商事判決的承認與執(zhí)行。譚律師以中國國際經濟貿易仲裁委員會（CIETAC）以及深圳國際仲裁院（SCIA）為例，介紹了中國主要的商事仲裁機構以及國際商事仲裁在中國的運作情況。他指出，在中國加入1958年《紐約公約》（“關于承認和執(zhí)行外國仲裁裁決”）后，中國的仲裁開始積極發(fā)展。中國國際經濟貿易仲裁委員會（CIETAC）自1956年成立以來，一直在商界享有崇高的權威性，成為解決經貿爭端的重要平臺。與此同時，深圳國際仲裁院（SCIA）在國際商事仲裁領域也取得了顯著成就，受理的案件數(shù)量達到新的高峰。特別是2023年涉外爭議金額高達593.26億元，這一數(shù)字不僅展示了SCIA處理復雜、大規(guī)模爭議的能力，也使其在亞洲主要仲裁機構中脫穎而出。
借由本次論壇，中俄兩國的法律精英在此深入交流，思維碰撞出火花，對兩國的商業(yè)合作有了更深刻的理解。會后，我所譚岳奇律師、閆鵬和律師以及張逸軒律師和Ingvarr律所的合伙人律師Igor Mazilin及Igor Kokin共同參觀了俄羅斯多家知名公司，與各行業(yè)人士就商貿問題進行了友好交流。展望未來，中俄雙邊貿易合作前景廣闊，令人充滿期待。

Yueqi(Vincent) Tan from Beijing Zhong Yin(Shenzhen) Law Firm was invited to Participate in the Russian-China Legal Forum and Visited a Number of Well-known Russian Enterprises
On 15th April 2024, Mr. Penghe Yan and Mr. Yixuan Zhang of Zhong Yin Law Firm and Mr. Yueqi(Vincent) Tan of Zhong Yin(Shenzhen)Law Firm were invited to Moscow to participate in the Russia-China Legal Forum, which was jointly organized by Pravo.ru (Russia’s largest online legal media), Ingvarr and Zhong Yin Law Firm.
The forum brought together about 150 people, including the legal leaders and elite legal teams of large Russian companies on the Forbes global list and a number of well-known companies, as well as representatives of outstanding lawyers from China and Russia. Participants gathered together to discuss how to use the power of law to further promote the prosperous development of China-Russia business cooperation, and had fruitful exchanges and discussions on the differences between China and Russia in terms of entrepreneurial mindset and legislative and regulatory systems.
Firstly, Mr. Penghe Yan introduced the foreign-invested enterprises in China and the legal issues of M&A. Then, Mr. Yixuan Zhang discussed the protection of intellectual property rights in international business in the light of technological development Finally, Mr. Yueqi(Vincent) Tan introduced dispute resolutions in China from the perspective of litigation and arbitration.
In terms of dispute resolutions, Mr. Yueqi(Vincent) Tan introduced to the guests the jurisdiction, applicable law in foreign-related litigation and recognition and enforcement of civil and commercial awards in China. Taking the China International Economic and Trade Arbitration Commission (CIETAC) and the Shenzhen Court of International Arbitration (SCIA) as examples, Mr. Tan introduced the main commercial arbitration institutions and their operations in China. He pointed out that arbitration in China started to develop actively after China’s accession to the 1958 New York Convention (“the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards”). Since its establishment in 1956, the CIETAC has been enjoying high authority in the business community and has become an important platform for resolving commercial and trade disputes. Meanwhile, the SCIA has also made remarkable achievements in the field of international commercial arbitration, with the number of cases accepted reaching a new peak. In particular, the amount of foreign-related disputes in 2023 was as high as RMB 59.326 billion, a figure that not only demonstrates SCIA’s ability to handle complex and large-scale disputes, but also sets it apart from other major arbitration institutions in Asia.
Through this forum, the legal elites of China and Russia had in-depth exchanges, and their thinking collided with sparks, and they had a deeper understanding of the business cooperation between the two countries. After the forum, our lawyers and Igor Mazilin and Igor Kokin from Ingvarr visited a number of Russian companies and had friendly communications with people from various industries in terms of trade. Looking forward to the future, China-Russia bilateral trade co-operation has a broad prospect and is full of expectations.
